2. What personal data is collected and for what purpose is it processed?

As part of and exclusively for the purpose of using PENDLA’s commute platforms (“the platform”), the following personal data of the user are collected (“user data”): last name, first name, home address, work address, profile text, company name, travel route, travel times, email address, phone number, IP address, as well as other personal data and photos that the user himself/herself deposits on the platform.

3. How long is the user data stored?

The user data is stored for as long as the intended purpose, i.e. the provision and use of the platform, requires it.

4. What is the legal basis of the processing?

4.1. User data is processed on the basis of the consent given by the user when registering on the platform.

4.2. The platform processes the user data according to the EU data protection basic regulation and the applicable data protection law.

5. Who has access to the user data and to whom is it passed on?

5.1. Access to the user data is available to all entities within the PENDLA Group that need the data in the context of providing the platform or to protect the legitimate interests of PENDLA.

5.2. As operator of the platform, PENDLA has access to the user data.

5.3. The user data is accessible to all users registered on the platform.

5.4. PENDLA reserves the right to pass on the user data to processors within the framework of the provision of the platform. These processors may be located in a country outside the European Union or the European Economic Area. In such a case, the processors are obliged to comply with data protection.

5.5. Furthermore, user data can be disclosed if this is required by law (e.g. to authorities, courts etc.).

6. User rights

The user is entitled to the following data protection rights with regard to his user data (Art. 15 to 21 DSGVO):

6.1. Right of withdrawal: The user has the right to withdraw his consent at any time by deactivating his user account with effect for the future. The legality of the data processed until the revocation is not affected by this. The revocation also has no influence on data processing based on other legal bases.

6.2. Right to information: The user can demand information about the extent to which his user data is processed.

6.3. Right to correction, deletion and restriction of processing: The User has the right to demand the correction of his incorrect or incomplete User data without delay, insofar as he cannot make these changes independently within the Platform. In addition, the user data must be deleted if this data is no longer necessary for the purposes for which it was collected or processed, if the user has revoked his consent or if this data is processed unlawfully. Furthermore, the user has the right to demand the restriction of the processing.

6.4 Right to data transferability: The user has the right to receive the user data provided by him in a structured, common and machine-readable format.

6.5 Right of complaint: The user has the right to lodge a complaint with the competent supervisory authority or another supervisory authority of an EU or EEA member state (e.g. at the place of residence or work or at the place of any violation of the DSGVO). 6.6 Right of objection

a. In individual cases: If the processing of user data is carried out in the public interest or to protect the legitimate interests of PENDLA or a third party, the user has the right to object to this processing at any time for reasons arising from his or her particular situation.

b. Direct mail: The user has the right to informally object to the use of his or her user data for direct mail at any time. In the event of an objection to this processing, the user data will no longer be processed for this purpose.

Requests should preferably be made in writing to the Data Protection Officer. He is also available to users as a contact person for all other questions relating to data protection law.

7. Statistical usage analysis

7.1 Plausible: This website uses the web analysis and statistics tool Plausible. Plausible works without cookies, does not store any information in the browser and generally does not collect any personal data. Privacy policy of Plausible: https://plausible.io/data-policy

8. Interactive map display

The map-based application is based on Mapbox, a digital map service provided by Mapbox Inc, 740 15th St NW, Washington, DC 20005, USA. By using it, a direct connection to Mapbox servers is established and usage information including your IP address and location data may be transmitted to Mapbox. Map content is transmitted by Mapbox directly to the end device and integrated into the application. Mapbox is used for the purpose of map-based interactive presentation of geographical information and constitutes a legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO. PENDLA reserves the right to adapt the privacy policy and to publish it here and linked on the platform (see update date at the beginning of the document).
